In a recent legal development, a woman in her 30s has been sentenced to a term of imprisonment following her unfounded rape accusation against her biological father, who had financially supported her overseas education, after he declined to provide additional funds.
As reported by the legal sector on the 1st, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, presided over by Judge Choi Chi-bong, has sentenced the woman, referred to as A, to a 10-month prison term on charges that include defamation, business obstruction, and insult.

Between May and June of the previous year, A posted false allegations on an online forum 11 times, under the headline "I am a victim of familial sexual violence. Please look at this," which led to the defamation of her father, known as B.
These posts contained fabricated claims such as, "I have been continuously sexually assaulted by my biological father since age four, and my mother was also subjected to domestic and sexual abuse," "The issue was resolved with a compensation of 30 million won," and "Severe punishment is necessary."
In doing so, A revealed B's real name and details about his business operations, reportedly causing him significant business-related challenges.
Moreover, A is alleged to have posted six times asserting that B's remarriage was with a woman, C, whom he allegedly had an affair with.

In February 2021, A initiated a damages lawsuit against B at the Incheon District Court, citing sexual assault, but failed to substantiate these claims with any illegal conduct evidence.
Throughout the criminal proceedings, A maintained the veracity of her statements; however, the court dismissed her assertions, referencing the lawsuit's outcome. The court highlighted the absence of corroborative evidence or circumstances supporting A's claims of habitual sexual assault by B.
Additionally, the court reasoned that A's allegations were likely false, given B's financial support during her time abroad and upon her return, and the timeline of her accusation shortly after her request for a substantial sum to open a cafe was denied by B.

The court stressed, "Her dissemination of false information stemmed from frustration over financial denial. The reputational damage inflicted upon the victims is irreparable."
The court further elucidated its sentencing rationale, noting, "The high possibility of recidivism, given her continued dissemination of similar content post-crime, alongside the victims' strong demand for stringent measures against the defendant, were key considerations in the sentencing decision."
